California Employment Law Firm
Many employees don't understand their rights when it comes to sick time, disability leave and other types of employee leave. If your employer denies your request for leave or fires you for taking leave, you may have a right to compensation from your employer.
I'm San Francisco employment lawyer Stephen M. Murphy. I represent employees throughout the Bay Area of Northern California who have been illegally denied leave from their employers or whose employers have retaliated against them for taking leave. I offer a free initial consultation to discuss your case and explain your options.
Types of Employment Leave
The law requires employers to provide you with the following types of leave in California:
- FMLA leave
- Pregnancy, maternity or paternity leave
- Disability leave
- Military leave
- Leave for spouses of military personnel who are on leave
- Paid sick leave in California
- Sick leave to take care of a family member. (Under Labor Code Section 233, if your employer provides sick leave for employees, you can use sick leave to take care of a family member.)
- Workers compensation leave
- Jury service leave
- Alcohol and drug rehabilitation leave
In addition, the law protects you from adverse employer actions for taking leave. Examples of adverse employer actions include firing you, demoting you, not promoting you or transferring you to a less desirable location or shift.
